Really, the first step I would say, is preparing yourself to go through the emotional struggles and battles of the divorce. Try to rehabilitate the relationship and to go to therapy. Try to speak to your family, your friends, and most important, your spouse, and make this decision together.
A lot of times what happens is people are in a long-term marriage, and they don’t even communicate at all. In those particular cases where divorce is sort of ready to go, I tell them to be prepared on a financial basis. That means get the paperwork, i.e. tax returns, credit card slips, bank statements. Start making photocopies of things, and get the information and the data. We’re going to use discovery tools, subpoenas, and depositions to obtain information, however, sometimes you find information in the house, car, and people’s belongings that you may not find with a subpoena and stuff.
