There are four basic types of alimony that are generally available during divorce negotiations in New Jersey. The first type of alimony, and likely the most well-known, is open durational alimony. This award results in spousal support for an unspecified period of time.
It is important to note that this is not the only type of alimony award available during divorce. Three additional options outlined by New Jersey state law to take into consideration include:
- Rehabilitative alimony. This form of alimony generally requires a plan that outlines the steps and time frame expected before the recipient would find suitable employment. Modifications are available, including when extenuating circumstances result in a delay in employment.
- Limited duration alimony. As the name implies, this form of alimony award results in a payment that will expire.
- Reimbursement alimony. The court will generally agree upon the award of this form of alimony in cases where it is clear one party provided financial support to the other through an advanced education in anticipation of the fruits of the increased earning capacity that would result from the education or training opportunity. The court does not generally allow modification of this form of alimony.
Anyone considering an alimony award as a part of a divorce settlement agreement likely has additional questions about this process. An attorney experienced in these matters can help discuss the particulars that will impact your case.
